Just read that Amy's ice cream is suing Amy's frozen foods. I like the frozen food items that Amy's offers, but it appears that they are now trying to do frozen treats.....I'll have to admit, when I first saw the frozen entrees, I did do a double-take. Does this lawsuit have any merit?
I'm not sure about the legal ins and outs, but as a consumer if I saw Amy's ice cream at a grocery store, I would assume it was from our local ice cream chain and not the frozen burrito folks. She's doing the right thing by trying to protect her business' name.
They don't stand a chance of preventing Amy's Kitchen from selling ice cream. Amy's Ice Cream is a small very localized chain of only 14 outlets who doesn't sell their ice cream in grocery stores.
AT most Amy's Kitchen may cave in and agree not to distribute them in Central Texas. But I don't see Amy's Kitchen throwing away all the money spent on research and product development of a new line of ice cream because of this lawsuit.
